Election Petition: SC to begin trial Jan. 26

The Supreme Court will resume sitting on Tuesday, 26 January, 2020, to hear the substantive matter in the ongoing 2020 election petition.

The court has set out five issues for next Tuesday’s trial.

The witness statements are expected to be filed by Thursday, 21 January 2021, while arguments on the Preliminary Legal Objections by the Respondents must be filed by Friday, 22nd January 2021.

Also, arguments in response to the Preliminary Legal Objections by the Respondents must be filed by Monday, 25 January, 2021.

The petitioner, Mr Mahama was however not in court today.

The panel is chaired by Chief Justice Kwasi Anin-Yeboah, with support from Justice Yaw Appau, Justice Nene Amegatcher, Prof Nii Ashie Kottey, Justice Mariama Owusu and Justice Gertrude Torkonoo and Justice Samuel Marful-Sau.

Meanwhile, the review for application for interrogatories will be heard on Thursday, 21 January, 2020.

Mr Mahama, has an application to ask the Supreme Court to review its decision to disallow him from asking the Electoral Commission (EC) certain questions at the ongoing hearing of the 2020 election petition.

Lead Counsel for Mr Mahama, Mr Tsatsu Tsikata on Wednesday, 20 January, 2020 informed the court about the filing of the application.

In this new application, Mr Mahama is asking for a review of the ruling on the application for interrogatories after the court dismissed the application for interrogatories. 

In order to do the review, the court would have to empanel two additional Supreme Court Justices. 

The Supreme Court, on Tuesday, 19 January 2020, dismissed an application to serve interrogatories on the Electoral Commission (EC) filed by former President John Dramani Mahama, who is the petitioner in the ongoing election petition.
